Autizan – Terms of Service

Cloud Space LLC (“Cloud Space,” “we,” “our,” or “us”) provides the Autizan mobile application and any related sites or services (collectively, the “Service”). By creating an account, installing, or using the Service you (“you” or “your”) agree to these Terms. If you do not agree, do not use the Service.

Eligibility and Parental Consent
- You must be at least 18 years old to create an account and use the Service.
- For Users Under 18. If you are under the age of 18, you may only use the Service with the express permission and direct supervision of your parent or legal guardian, who agrees to be bound by these Terms on your behalf.
- COPPA Compliance (For Children Under 13). The Service is not intended for unsupervised use by children under 13. In compliance with the Children's Online Privacy Protection Act (COPPA), we require verifiable parental consent before we knowingly collect, use, or disclose personal information from a child under 13. If you are a parent or legal guardian permitting a person under the age of 13 (“Child”) to use the Service, you agree to:
- Supervise the Child’s use of the Service at all times;
- Assume all risks and liabilities associated with the Child’s use of the Service and their interpretation of any content;
- Be responsible for ensuring the appropriateness and accuracy of any information submitted by the Child;
- Be fully responsible for the Child’s compliance with these Terms.

Your Account
- Keep your username and password secret. You are responsible for everything done under your account.
- Tell us at once at support@autizan.com if you suspect unauthorized use.
- You may have only one account and you may not sell, transfer, or give it away.

Subscription, Billing, and Cancellation
- Subscription. The Service is sold on a recurring-billing basis. The price, billing cycle, and any introductory offers are shown in-app before you buy.
- Automatic Renewal. Your plan renews at the end of each billing cycle unless you cancel. Your payment method on file will be charged the then-current price plus any taxes.
- Cancel Any Time. You can cancel through the same app store or account settings you used to buy the plan. Cancellation stops future charges; we do not give partial-period refunds except where the law or the app store’s rules require it.
- Changes. We may change subscription prices or features. We will give at least 30 days’ notice by email or in-app message and you may cancel before the new price applies.
- Free Trials. If offered, a trial converts to a paid plan unless you cancel before the trial ends.

License and Intellectual Property
- We give you a limited, non-transferable, revocable license to install and use the Service for your personal, non-commercial use.
- We and our licensors own all rights in the Service, including software, text, images, and AI-generated content.
- You may not copy, reverse-engineer, resell, or create derivative works from the Service unless the law allows it despite this ban.

User Content
- “User Content” means anything you upload or input. You keep ownership but give us a worldwide, royalty-free license to use, store, reproduce, and display it to operate the Service.
- You must have all rights needed to post User Content and it must not be unlawful, harassing, or misleading.
- We may remove User Content at any time if we believe it violates these Terms or the law.

Reporting Misuse or Harm
If you encounter any content or user behavior on the Service that you believe is inappropriate, violates these Terms, constitutes misuse, or has caused harm, please report it to us immediately at support@autizan.com. Please provide a detailed description of the issue and any relevant information (such as screenshots) so we can investigate it promptly.

Acceptable Use Rules
You agree you will not:
- Access or try to access accounts or systems you are not authorized to use;
- Upload viruses, malware, or other harmful code;
- Collect personal data from other users;
- Use the Service to provide medical, psychological, or legal advice;
- Decompile, disassemble, or otherwise attempt to get source code;
- Interfere with the Service’s normal operation.

Important Disclaimers and User Responsibilities
The Service uses artificial intelligence to create prompts and suggestions intended to aid social-emotional learning. By using the Service, you acknowledge and agree to the following:
- Not a Substitute for Professional Advice. Autizan is a tool designed to supplement learning and support skill development. It is not a replacement for professional medical advice, diagnosis, licensed therapy, or treatment. Always consult a qualified healthcare or mental health professional for any medical or psychological matters. Never disregard professional advice or delay in seeking it because of something you have read or seen on the Service.
- No Crisis Response. THE SERVICE IS NOT A CRISIS SUPPORT SERVICE. It does not monitor for, and is not designed to respond to, crisis situations. If you or someone you know is experiencing a mental health crisis, feeling suicidal, or is in any kind of danger, do not use this app for help. Please contact a crisis hotline or emergency services immediately. In the U.S., you can call or text 988 or call 911.
- User Responsibility. You are solely responsible for how you interpret and apply any suggestions, prompts, or information generated by the Service. Your use of the Service and reliance on any of its content is entirely at your own risk. Parents and legal guardians are responsible for supervising their child’s use of the Service and for determining the suitability of its content for their child.
- AI Limitations and Bias. You acknowledge that the artificial intelligence used by the Service has inherent limitations. AI-generated content may contain inaccuracies, reflect unintended biases from its training data, or fail to consider the full context of your situation. The AI is constantly learning and improving. We encourage you to critically evaluate all responses and not rely on them as a sole source of truth or professional guidance.

Privacy
Our Privacy Policy explains how we collect, use, and share data. It is part of these Terms. You consent to our data practices by using the Service.

Third-Party Services
Links or integrations with third-party sites are provided for convenience. We do not control their content and are not responsible for any damage or loss caused by those sites.

Suspension and Termination
We may suspend or close your account, or block access to the Service, without notice if we believe you violated these Terms or the law. You may stop using the Service and close your account at any time.

Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

Limitation of Liability
To the fullest extent allowed by law, you agree that Cloud Space, its affiliates, and their officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. This includes, without limitation, any damages or harm resulting from your use of the Service or your reliance on any suggestions, advice, or information it provides. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD $100.

Indemnification
You agree to defend and hold Cloud Space and its affiliates harmless from any claim, loss, or demand, including reasonable legal fees, arising from your (a) use of the Service, (b) User Content, or (c) breach of these Terms.

Governing Law
Delaware law governs these Terms and any dispute related to the Service, without regard to Delaware’s conflict-of-laws principles.

Arbitration and Class-Action Waiver
- Any dispute that we cannot resolve informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
- The arbitration will take place in Wilmington, Delaware, unless the arbitrator allows remote proceedings.
- Class-Action Waiver. You and we agree that claims will be brought only on an individual basis and not as a class action, class arbitration, or representative action.
- Either party may seek injunctive relief in any court of competent jurisdiction for misuse of intellectual property or breach of confidentiality.

Updates to These Terms
We may change these Terms by posting a revised version and updating the “Effective Date.” Changes apply when posted. If you keep using the Service after the new Terms take effect, you have agreed to accept the changes. If you do not agree, you must stop using the Service.
